Adis 24/7 Alcohol and Drug Support (Adis) – Chat terms and conditions of use

Queensland Health through Metro North Hospital Health Service’s (MNH) Adis Chat platform allows you to talk directly to Adis counsellors.

Terms and Conditions of Use

These terms and conditions of use outline the terms under which you may access and use the Adis Chat platform. Please read it carefully before using the platform.

By accessing using MNH’s Adis Chat platform you agree to these terms and conditions.

Purpose and Disclaimer

The Adis Chat platform is to provide initial point of contact for support and counselling for alcohol and drug issues.

The Adis Chat platform is not intended to diagnose, treat or cure any medical condition, nor it intended to be used for therapeutic purposes or as a substitute for a health professional's advice.

The diagnosis and treatment of a clinical condition can only be undertaken in person by a qualified healthcare professional. You should always seek the advice of a qualified healthcare professional with any questions you have regarding your health or a medical condition.

Clinical material available on or through this website or platform does not replace clinical judgement.

If you (a) require urgent medical attention or (b) are in immediate danger or (c) are at risk of harming yourself or someone else, call Emergency Services on 000.
 

Appropriate use of Adis Chat

You must only use  Adis Chat for the purposes described in these Terms and Conditions of Use. You must not use or attempt to use Adis Chat to:

  1. send any offensive, inflammatory, defamatory, fraudulent, obscene or otherwise unlawful information or information that infringes third party rights
  2. adversely affect the reputation or public image of MNH
  3. threaten, intimidate, cause annoyance or inconvenience to MNH, its staff and personnel or any third party.
  4. post, link to, distribute or transmit any information, material or item which contains a virus or other harmful component designed to interrupt or limit functionality of computer software or hardware.

You acknowledge that MNH can terminate your use of Adis Chat if MNH reasonably believes that you have breached these Terms and Conditions of Use.

Communications

During your chat with an Adis counsellor, you may provide personal information including your:

  1.  name or alias if you would like us to address you during the session
  2.  age which we record for demographic and statistical research purposes
  3. telephone number if you would like us to contact you following the chat for follow up purposes

In providing MNH telephone number, you consent to MNH using your telephone number to contact you for the above purposes or as permitted by applicable laws and regulations.

Privacy

A transcript of your chat will be stored in accordance with Queensland Health's Privacy Policy.

Any personal information (including personal health information) you provide during your use of the Adis Chat platform will be collected by QH in its capacity as the  Chat service provider for statistical and research purposes. MNH will handle the Information it collects about you in accordance with these Terms and Conditions of Use and the Queensland Health’s Privacy Policy.

You may choose to access and use Adis Chat on an anonymous basis and/or nominate an alias for use by the Adis representative during your use of the chat platform, however, this will limit MNH’s ability to provide any follow up, where required.

If you provide personal identifying information about another person as part of your use of the Adis Chat platform, you must ensure that, prior to providing the personal identifying information about that person, the person is aware of how their information will be handled under these Terms and Conditions of Use and that they consent to the handling of their information in accordance with these Terms and Conditions of Use.

MNH will disclose your personal information and I.P address if we do not have your personal information, to the relevant authority if we become aware that:

  • A child or young person is at risk of harm. This includes physical, sexual, emotional, psychological abuse or neglect; or
  • You or another adult is at serious risk of harm

Intellectual property rights

You acknowledge that all intellectual property rights (including copyright) regarding Adis Chat including the transcripts of any Chat ("Adis Materials") is owned by or licensed to MNH. You may not otherwise use, copy, change, communicate, sell or otherwise deal with the Adis materials without MNH’s express prior written consent.

De-identified information from chats (including chat transcripts) may be used for training purposes, reporting or research.

Terms of use

We reserve the right to change, suspend or discontinue all or any aspects of the Adis Chat platform and service at any time without further notice.

Termination of use

We reserve the right (but are not obliged) to:

  • remove communications that fail to conform with these terms of use
  • terminate a user's access to the entire service or specific features
  • edit or delete any communications, regardless of whether such communications violate these standards.

Liability

MNH cannot and does not assume any responsibility or liability for any information you submit while using Adis Chat or misuse of information transmitted or disclosed via the  chat platform. MNH does not warrant or represent that the information you submit via the Adis Chat platform will be protected against loss, misuse or alteration by third parties.

You understand and agree that the Adis Chat platform and any services, content or information contained on or provided by or through the Adis Chat platform is provided on an "as is" basis.

MNH does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service or any information provided through the service. In addition, we do not guarantee that use of the Adis Chat platform will be free from technological difficulties including, but not limited to unavailability of information, downtime, service disruptions, viruses or bugs.

To the extent permitted by law, MNH excludes all liability for any loss or damage whatsoever (including consequential or incidental damage) and however arising (including due to negligence) that you may suffer, directly or indirectly, in connection with your use of the Adis Chat platform (including the use of any links). In particular, we exclude all liability for any loss or damage that may result from your use of, or reliance upon, any information or material obtained from use of the Adis Chat platform.

Indemnification

You agree that you will indemnify the Metro North Hospital and Health Service and any officers, employees and agents of the Metro North against any liability including third party claims, loss, damage, or expense (including legal costs on a solicitor and client basis) incurred or suffered as a direct or indirect result of or arising out of or in connection with (i) your use of the Adis Chat platform and/or (ii) your reliance upon any information provided to you from use of the Adis Chat platform and/or (iii) any breach by you of these Terms and Conditions of Use.

Links to third party websites

 The Adis Chat platform must not be linked to any third party website without the prior written consent of QH

General

These Conditions of Use are governed by the laws in the State of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of that State and all courts with jurisdiction to hear appeals from those courts.
